Terms of Use
These Terms of Use govern access to and use of Kontami by customers and independent service professionals in the United States.
1. Agreement
These Terms are a binding agreement between you and KONTAMI LLC, the operator of Kontami. By creating an account or using Kontami, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts. You must provide accurate information and keep your account secure. You are responsible for activity through your account and must promptly report suspected unauthorized access.
3. Marketplace role
Kontami is a technology marketplace that helps customers and independent service professionals find and communicate with one another. Kontami is not a contractor, construction professional, employer, employment agency, joint venturer, agent, insurer, or party to agreements made between users. Kontami does not perform, supervise, direct, or control home services.
Professionals are independent businesses or individuals and are solely responsible for their work, pricing, tools, personnel, taxes, permits, licenses, insurance, safety, and compliance with law. Customers decide whom to hire and remain responsible for evaluating professionals and the suitability of proposed work.
4. Accounts and profiles
Users may not impersonate another person, create deceptive profiles, misrepresent qualifications, licenses, insurance, reviews, location, or identity, or allow unauthorized use of an account. Kontami may request verification but does not guarantee that verification identifies every risk or establishes a professional’s competence.
5. Projects, offers, and agreements
Customers are responsible for providing accurate project information and for not posting unlawful or unsafe requests. Offers, estimates, schedules, warranties, payments, cancellations, change orders, permits, and the scope and quality of work are agreed directly between the customer and professional. Unless Kontami expressly introduces a payment feature with separate terms, payments occur outside Kontami and at the users’ own risk.
Kontami does not guarantee that a customer will receive offers, that a professional will receive work, or that any user will complete a transaction.
6. Location and privacy
Public project listings should use an approximate area or ZIP code. Users must not publish another person’s precise address, access codes, financial information, identification numbers, or other sensitive information. A customer may privately provide a precise service address to the selected professional when reasonably necessary.
7. User content
You retain ownership of text, photographs, reviews, messages, and other content you submit. You grant Kontami a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, and transmit that content only as reasonably necessary to operate, secure, promote, and improve Kontami.
You represent that you own or have permission to submit the content and that it does not violate privacy, intellectual-property, publicity, or other rights. Kontami may remove content that violates these Terms or creates legal or safety risk.
8. Prohibited conduct
You may not use Kontami to commit fraud; threaten, harass, discriminate, or exploit others; post illegal, dangerous, deceptive, or infringing content; scrape or harvest data; send spam; manipulate reviews; interfere with security; introduce malicious code; evade account restrictions; or use information obtained through Kontami for unrelated solicitation or unlawful purposes.
9. Safety, licensing, and insurance
Users are responsible for assessing job-site conditions and following applicable safety rules. Professionals must hold every license, registration, permit, bond, and insurance required for the services and location involved. Kontami may display information supplied by users or third parties but does not guarantee that it is current, complete, or accurate. Customers should independently verify credentials before hiring.
10. Communications
You agree that Kontami may send account, security, project, offer, message, and service notifications by email, browser notification, or other contact method you provide. You may control optional communications through available settings, but essential service communications may continue while your account is active.
11. Suspension and termination
You may stop using Kontami at any time. Kontami may restrict, suspend, or terminate access, remove content, or preserve information when reasonably necessary to protect users, investigate suspected violations, comply with law, or maintain the service. Provisions that by their nature should survive termination will survive.
12. Disclaimers
Kontami is provided “as is” and “as available.” To the maximum extent permitted by law, Kontami disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Kontami does not warrant uninterrupted operation or the identity, conduct, qualifications, availability, pricing, legality, safety, or quality of any user or service.
13. Limitation of liability
To the maximum extent permitted by law, Kontami and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal injury, property damage, defective work, or disputes between users arising from use of the marketplace. To the maximum extent permitted by law, Kontami’s total liability arising out of or relating to the service will not exceed the greater of (a) $100 or (b) the amount you paid directly to Kontami during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kontami and its affiliates from claims, losses, liabilities, and reasonable expenses arising from your content, your services or projects, your violation of these Terms or law, or your infringement of another person’s rights.
15. Disputes and governing law
Before filing a claim, you and Kontami agree to attempt in good faith to resolve it through written notice for at least 30 days. These Terms are governed by the laws of California, without regard to conflict-of-law principles. Any lawsuit that is not resolved informally must be brought in a state or federal court located in Los Angeles County, California, and each party consents to personal jurisdiction and venue there, except where applicable law requires a different forum.
16. Changes
We may update these Terms as Kontami changes. We will post updated Terms with a new effective date and provide additional notice when required. Continued use after the effective date constitutes acceptance where permitted by law.
